PRivacy Policy
Any customer, agent, or third party of any kind, or in the case of a child under the age of thirteen (a “Minor”) then such Minor and such Minor’s respective parent or legal guardian (collectively, the “User”) in the course of enrolling in any online modules, courses, videos, programs and/or workshops with The Beanstalk Project Ltd., the Beanstalk Academy (as defined hereafter) or any of its affiliates or subsidiaries (collectively, “The Beanstalk Project”) or when accessing The Beanstalk Project websites at https://beanstalkcreative.org/, https://beanstalkacademy.org/, https://beanstalkeducators.org/, https://www.thebeanstalkproject.org/ or any other related website or content administered by The Beanstalk Project Ltd. (collectively, the “Websites”) may provide personal information to The Beanstalk Project.
Protecting a User’s privacy is paramount to The Beanstalk Project. To accommodate any concerns with how personal information is protected, The Beanstalk Project has created this policy (this “Privacy Policy”), which articulates how The Beanstalk Project collects, uses and discloses personal information obtained by The Beanstalk Project when Users are visiting and/or using the Websites to ensure that The Beanstalk Project protects the personal information and privacy of its Users and Customers (as defined hereafter), and complies with applicable privacy legislation.
Definitions
“Beanstalk Academy” means those online courses, modules, programs and/or workshops in which The Beanstalk Project provides its customers through the Websites.
“Cookies” are small text files placed on a User’s hard drive that assists The Beanstalk Project in providing a customized browsing experience. Cookies contain a unique identification number that identifies a User’s browser, but not the User to The Beanstalk Project’s computers each time a User visits the Websites. The Beanstalk Project uses cookies to make navigation of the Websites easier for Users and to facilitate efficient registration procedures. If a User is concerned about Cookies, most internet browsers permit a User to refuse to accept all cookies or to notify Users when a User has received a cookie; however, a User should note that if the User refuses to accept Cookies, the User may not be able to use some or all of the features available on the Websites.
“Contractors” means independent individuals hired by The Beanstalk Project in order to provide a service to us, possibly in facilitating the delivery of a good or service to our Customers including but not limited to the course offerings of the Beanstalk Academy. Contractors shall include but not be limited to, instructors, facilitators, technicians or developers.
“Customer” means anyone who purchases goods and services from The Beanstalk Project arising from or related to the Websites. Customers shall include, but not be limited to, Users, teachers or school boards who wish to enroll their respective students in at least one (1) of the Beanstalk Academy’s course offerings.
“Fourth Party” means a business that a Third Party uses to facilitate the delivery of such Third Party’s goods and/or services to The Beanstalk Project related to or arising from the Websites, including but not limited to the Beanstalk Academy course offerings. While we do not have a direct contract with these Fourth Parties, our Privacy Officer uses commercially reasonable efforts to ensure that our Third Party vendors have appropriate security measures in place regarding their respective Fourth Parties and that they (i) inform us of any security breaches or concerns with respect to such Fourth Parties, and (ii) have privacy policies around due diligence and oversight of outsourced services.
“Personal Information” is defined in PIPEDA as information about an identifiable individual, but does not include the name, title, business address or telephone number of any employee of an organization. In other words, it does not include the information that one expects to find on a business card or information that is available in public records. “Single-Pixel Tags” are graphics that function similar to Cookies and are used to collect information in web logs that do not identify a User personally but include information regarding web pages viewed, the websites a User came from and the advertisement the User clicked on to visit the Websites, if applicable.
“Third Party” means a business that The Beanstalk Project enters into a contract with in order to facilitate the delivery of the Beanstalk Academy to Users by facilitating transactions, email services, content hosting, payment processing or other digital services not otherwise rendered by The Beanstalk Project.
“Staff” means paid employees of The Beanstalk Project.
“User” means anyone who accesses the Websites or course offerings of the Beanstalk Academy or attends a live workshop, assembly or event hosted and managed by The Beanstalk Project, and shall include Customers.
Privacy Legislation
Since January 1, 2004, all Canadian organizations engaged in commercial activities have been required to comply with the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and the Canadian Standards Association Model Code for the Protection of Personal Information, incorporated by reference into PIPEDA. These obligations extend to The Beanstalk Project and are integrated into this Privacy Policy.

Consent
The Beanstalk Project uses commercially reasonable efforts to provide Users with sufficient detail surrounding the collection and storage of Personal Information, in order to ensure adequate consent is obtained from Users. By using the Websites, the User consents to The Beanstalk Project’s collection, use and disclosure of the User’s Personal Information in accordance with this Privacy Policy, including that by Third Parties to whom The Beanstalk Project has contracted with in order to provide Users access to the Websites. If the User does not consent to all the terms set out in this Privacy Policy and or the privacy policies of any Third Party, accessible below, the User must immediately cease use of the Websites. Please note that the User’s access and continued use of the Websites will be deemed as consent by The Beanstalk Project.
This Privacy Policy does not apply to personal information collected from offline resources and communications, except in cases where such personal information is consolidated with personal information collected by The Beanstalk Project. This Privacy Policy also does not apply to third-party online resources to which the Websites may link, where The Beanstalk Project does not control the content or the privacy practices of such resources.
What Personal Information is Collected?
The Beanstalk Project collects only the limited Personal Information reasonably required in order to provide Users with access to our services and products related to the Websites and to conduct our business. Upon a User’s registration with the Beanstalk Academy and throughout the duration of the User’s use of the Websites’ contents, The Beanstalk Project collects Personal Information which may be deemed sensitive, including but not limited to, User names, e-mail addresses, telephone numbers, payment information and User progress data related to a particular online course, module or program of the Beanstalk Academy in which such User is enrolled.
How is Personal Information Collected?
Personal Information shall be collected by The Beanstalk Project using only legal and lawful means. The Beanstalk Project collects Personal Information in one (1) or more of the following ways:
Why is Personal Information Collected and What do we use it for?
Personal Information is collected in order to allow Users to access the Websites and to allow The Beanstalk Project to administer and facilitate the Beanstalk Academy and process enrollments and payments related thereto. Additionally, data pertaining to the Beanstalk Academy Users is collected in order to track an individual User’s learning progress and interactions with a respective course and/or module to assist the Beanstalk Academy with User progress reporting.
Personal Information pertaining to User registration is used only to facilitate technical, Customer and/or User support, which may include progress reporting, billing, and certificates of completion with respect to a particular course offered by the Beanstalk Academy. Reports on the Beanstalk Academy’s User progress are compiled automatically by a Third Party service provider and are used by The Beanstalk Project to support Customers in understanding the progress of related Users.
Personal Information may also be collected in order to audit online resources for authorized access and security as well as gather a User’s and/or Customer’s opinion and feedback on the Beanstalk Academy through surveys and/or questionnaires.
Where do we keep Personal Information?
Personal Information collected electronically is stored on the Beanstalk Academy online platform utilizing a Third Party platform. Personal Information provided to designated The Beanstalk Project Staff via e-mail is also stored in our Third Party e-mail management system.
How is it secured?
The Beanstalk Project employs physical, administrative and technological security safeguards appropriate to the sensitivity of the Personal Information. The Beanstalk Project will take all reasonable steps to protect Personal Information provided by Users and/or transmitted from a User’s computer to the Websites or other online resources and servers. Such safeguards include, but are not limited to, the following:\
The Beanstalk Project uses commercially reasonable efforts to ensure that all affiliates and Third Parties that are retained to perform services on its behalf are enforcing security measures and privacy policies at least as stringent as this Privacy Policy. Please note that online security risks cannot be completely eliminated and The Beanstalk Project cannot and does not guarantee that a User’s Personal Information will not be disclosed in ways not otherwise described in this Privacy Policy.
Users should immediately report any privacy/security concerns they have to the Privacy Officer, including any unusual behavior on their Beanstalk Academy account or payment/transactional issues related to purchasing a course from the Websites. This will help us ensure your information is kept safe.
Who has access to or uses Personal Information?
Personal Information will be accessible to The Beanstalk Project and to individuals and organizations that use the Personal Information for and at the direction of The Beanstalk Project in order to assist in The Beanstalk Project’s delivery and access to the Websites and to facilitate the delivery of the Beanstalk Academy’s course offerings.
Within The Beanstalk Project, User Personal Information is accessible by two (2) Staff members designated as “Site Administrators”. They are tasked with managing the Beanstalk Academy for the purposes of delivering its course offerings to Users. The Site Administrators may have access to Personal Information, including but not limited to, User names, e-mail addresses, progress data, and transactional payment data. The Beanstalk Project also provides limited access to Personal Information such as User names and e-mail addresses to its Contractors, such as course instructors, on a need-to-know basis in order to facilitate the delivery of the Beanstalk Academy’s course offerings to such respective User.
The Beanstalk Project has engaged Third Parties in order to assist in the delivery and facilitation of the Websites and the Beanstalk Academy’s course and module offerings. As such, Third Parties may have access to Personal Information, including but not limited to, User names, e-mail addresses and billing addresses. These Third Parties are governed by privacy policies that require Personal Information to be protected appropriately. Please note that Third Parties may make use of services from Fourth Parties in order to assist in the Third Parties’ delivery of goods and services to The Beanstalk Project, which may have access to limited Personal Information. Upon the termination of a service contract with a Third Party, The Beanstalk Project shall use commercially reasonable efforts to ensure that any such Third Party returns or disposes of the transferred Personal Information.
Unless otherwise advised, The Beanstalk Project will not sell or share Personal Information except as described in this Privacy Policy and any other applicable privacy notices. However, The Beanstalk Project reserves the right to disclose Personal Information for the purpose of reporting to government authorities, to parties in relevant legal proceedings as authorized and directed by the presiding court or tribunal and otherwise to the extent required or explicitly authorized by law.
Who do we share it with?
Personal Information collected by The Beanstalk Project shall not be shared, used or disclosed for purposes other than that for which it was collected, except with the consent of the respective User or as required by law. Personal Information will be accessible to The Beanstalk Project and to individuals and organizations that use Personal Information solely at the direction of The Beanstalk Project. In addition to the above, The Beanstalk Project shares User information with related Customers for the purpose of progress reporting on such respective User’s progress and interactivity with a particular course or module of the Beanstalk Academy.
A User’s Personal Information will not be shared with anyone other than the respective User unless such User is under the age of sixteen, in which case, a parent or legal guardian may request reasonable information about such User’s account. In any other case, a User can provide consent for another person to access their data, including their Personal Information, by signing a consent form which is accessible by contacting the Privacy Officer.
When is the Personal Information disposed of?
User data, including Personal Information, is deleted by The Beanstalk Project after twelve (12) months of User inactivity on the Websites, as determined by The Beanstalk Project in its sole and absolute discretion, or when a User requests the information be removed.
How does a User limit disclosure of a User’s Personal Information?
A User may choose not to provide their Personal Information to The Beanstalk Project by electing not to enter any Personal Information into a form or data field on the Websites and by not using any personalized services provided by the Websites or any other related online resources. However, such an action may affect their ability to use and/or access the Beanstalk Academy.
If a User previously agreed to permit the use of Personal Information for marketing and/or promotional purposes, a User may revoke consent by following the opt-out or unsubscribe instructions in each communication and/or by writing to the Privacy Officer requesting the same.
The Beanstalk Project will use commercially reasonable efforts to ensure that Users will be informed of any material changes to this Privacy Policy, as determined in The Beanstalk Project’s sole and absolute discretion.
How may a User access and correct Personal Information?
The Beanstalk Project will use commercially reasonable efforts to ensure that Personal Information is as accurate, complete and as up-to-date as necessary for the purposes of conducting our business. Users are responsible for notifying The Beanstalk Project of any changes in Personal Information such as names and contact information. If a User believes that any of the User’s Personal Information collected by The Beanstalk Project is incorrect or incomplete, please send an e-mail to the Privacy Officer.
Additionally, upon written request to the Privacy Officer, The Beanstalk Project will provide a User with any Personal Information of such User collected and/or stored by The Beanstalk Project to the extent required by law.
Requests for Non-Disclosure, Inquiries and/or Complaints
The Beanstalk Project will respond to inquiries and/or complaints about its policies and practices relating to the handling of Personal Information. Inquiries and/or complaints should be directed to the Privacy Officer, Joel Hilchey, at [email protected]. The Beanstalk Project will investigate and respond within thirty (30) days of receipt of such inquiry or complaint. If a complaint is found to be justified, The Beanstalk Project will take appropriate measures to resolve such complaint, including, if deemed necessary by The Beanstalk Project, amending this Privacy Policy and related privacy procedures.
A User may withdraw their consent to the collection, use and disclosure of Personal Information by The Beanstalk Project at any time, subject to legal and/or contractual restrictions and upon reasonable notice, by contacting the Privacy Officer. Please note that certain Personal Information will be collected automatically when a User visits the Websites. A User’s continued use of the Websites will be deemed consent to obtain any Personal Information that derives from the User’s access and/or use of the Websites.
Terms and Conditions of Use of Websites
The Beanstalk Project’s Terms and Conditions of Use governing a User’s use of the Websites (accessible by clicking here) contains important provisions, including provisions disclaiming, limiting or excluding the liability of The Beanstalk Project for a User’s use of the Websites and provisions determining the applicable law and exclusive jurisdiction for the resolution of any disputes regarding a User’s use of the Websites. Each of those provisions applies to any disputes that may arise in relation to this Privacy Policy including any collection, use and disclosure of Personal Information and are of the same force and effect as if they had been reproduced directly in this Privacy Policy.
Third Party Links and Websites
The Websites may contain links to third-party websites or internet resources, which are not affiliated with the Websites and are not subject to this Privacy Policy. The User assumes the risk associated with the User’s use and/or access of any third-party links or websites. The Beanstalk Project assumes no responsibility or liability for, or control over any third-party websites or their collection, use and/or disclosure of a User’s Personal Information, other than as expressly set out herein.
Privacy Policy Amendments and Revisions
This Privacy Policy may be revised and/or amended at the sole discretion of The Beanstalk Project without prior notice or liability to the User or any other person. The collection, use and disclosure of the Personal Information by The Beanstalk Project will be governed by the version of the Privacy Policy in effect at that time when the information is collected, used or disclosed. New or amended versions of this Privacy Policy will be posted on the Websites and will be available to the User upon request to the Privacy Officer. A User’s continued access, use or dealings with the Websites after any amendments to this Privacy Policy will signify a User’s consent and continued consent to the collection, use and disclosure of Personal Information in accordance with the revised Privacy Policy.
Anti-Spam
The Beanstalk Project complies with the requirements of Canada’s anti-spam legislation (“CASL”) pertaining to unsolicited commercial e-mails, known as “spam” or “junk mail”. If a User subscribes for electronic communications or newsletters from The Beanstalk Project and/or the Websites, such User will have the option to immediately unsubscribe. - The Beanstalk Project may collect information from a User’s computer and other electronic devices when a User accesses the Websites. The information that may be collected during this process includes, but is not limited to, a User’s internet protocol (“IP”) address, domain name, browser type, date and time of a User’s request and information provided by tracking technologies such as Cookies and Single-pixel tags. If a User is accessing the Websites from a mobile device, The Beanstalk Project may collect information about the User’s device, such as a User’s device identification and device type, as well as usage information, use of mobile websites and other mobile resources.

- Limiting Staff’s access to Personal Information and Personal Information located on Third Party platforms to those on a need-to-know basis;
- Limiting sensitive Personal Information, such as payment information, stored on cloud-based servers;
- Periodically reviewing its technological security safeguards to mitigate security risks; and
- Limiting the storage of hard copies of any Personal Information.
The Beanstalk Project uses commercially reasonable efforts to ensure that all affiliates and Third Parties that are retained to perform services on its behalf are enforcing security measures and privacy policies at least as stringent as this Privacy Policy. Please note that online security risks cannot be completely eliminated and The Beanstalk Project cannot and does not guarantee that a User’s Personal Information will not be disclosed in ways not otherwise described in this Privacy Policy.
Users should immediately report any privacy/security concerns they have to the Privacy Officer, including any unusual behavior on their Beanstalk Academy account or payment/transactional issues related to purchasing a course from the Websites. This will help us ensure your information is kept safe.
Who has access to or uses Personal Information?
Personal Information will be accessible to The Beanstalk Project and to individuals and organizations that use the Personal Information for and at the direction of The Beanstalk Project in order to assist in The Beanstalk Project’s delivery and access to the Websites and to facilitate the delivery of the Beanstalk Academy’s course offerings.
Within The Beanstalk Project, User Personal Information is accessible by two (2) Staff members designated as “Site Administrators”. They are tasked with managing the Beanstalk Academy for the purposes of delivering its course offerings to Users. The Site Administrators may have access to Personal Information, including but not limited to, User names, e-mail addresses, progress data, and transactional payment data. The Beanstalk Project also provides limited access to Personal Information such as User names and e-mail addresses to its Contractors, such as course instructors, on a need-to-know basis in order to facilitate the delivery of the Beanstalk Academy’s course offerings to such respective User.
The Beanstalk Project has engaged Third Parties in order to assist in the delivery and facilitation of the Websites and the Beanstalk Academy’s course and module offerings. As such, Third Parties may have access to Personal Information, including but not limited to, User names, e-mail addresses and billing addresses. These Third Parties are governed by privacy policies that require Personal Information to be protected appropriately. Please note that Third Parties may make use of services from Fourth Parties in order to assist in the Third Parties’ delivery of goods and services to The Beanstalk Project, which may have access to limited Personal Information. Upon the termination of a service contract with a Third Party, The Beanstalk Project shall use commercially reasonable efforts to ensure that any such Third Party returns or disposes of the transferred Personal Information.
Unless otherwise advised, The Beanstalk Project will not sell or share Personal Information except as described in this Privacy Policy and any other applicable privacy notices. However, The Beanstalk Project reserves the right to disclose Personal Information for the purpose of reporting to government authorities, to parties in relevant legal proceedings as authorized and directed by the presiding court or tribunal and otherwise to the extent required or explicitly authorized by law.
Who do we share it with?
Personal Information collected by The Beanstalk Project shall not be shared, used or disclosed for purposes other than that for which it was collected, except with the consent of the respective User or as required by law. Personal Information will be accessible to The Beanstalk Project and to individuals and organizations that use Personal Information solely at the direction of The Beanstalk Project. In addition to the above, The Beanstalk Project shares User information with related Customers for the purpose of progress reporting on such respective User’s progress and interactivity with a particular course or module of the Beanstalk Academy.
A User’s Personal Information will not be shared with anyone other than the respective User unless such User is under the age of sixteen, in which case, a parent or legal guardian may request reasonable information about such User’s account. In any other case, a User can provide consent for another person to access their data, including their Personal Information, by signing a consent form which is accessible by contacting the Privacy Officer.
When is the Personal Information disposed of?
User data, including Personal Information, is deleted by The Beanstalk Project after twelve (12) months of User inactivity on the Websites, as determined by The Beanstalk Project in its sole and absolute discretion, or when a User requests the information be removed.
How does a User limit disclosure of a User’s Personal Information?
A User may choose not to provide their Personal Information to The Beanstalk Project by electing not to enter any Personal Information into a form or data field on the Websites and by not using any personalized services provided by the Websites or any other related online resources. However, such an action may affect their ability to use and/or access the Beanstalk Academy.
If a User previously agreed to permit the use of Personal Information for marketing and/or promotional purposes, a User may revoke consent by following the opt-out or unsubscribe instructions in each communication and/or by writing to the Privacy Officer requesting the same.
The Beanstalk Project will use commercially reasonable efforts to ensure that Users will be informed of any material changes to this Privacy Policy, as determined in The Beanstalk Project’s sole and absolute discretion.
How may a User access and correct Personal Information?
The Beanstalk Project will use commercially reasonable efforts to ensure that Personal Information is as accurate, complete and as up-to-date as necessary for the purposes of conducting our business. Users are responsible for notifying The Beanstalk Project of any changes in Personal Information such as names and contact information. If a User believes that any of the User’s Personal Information collected by The Beanstalk Project is incorrect or incomplete, please send an e-mail to the Privacy Officer.
Additionally, upon written request to the Privacy Officer, The Beanstalk Project will provide a User with any Personal Information of such User collected and/or stored by The Beanstalk Project to the extent required by law.
Requests for Non-Disclosure, Inquiries and/or Complaints
The Beanstalk Project will respond to inquiries and/or complaints about its policies and practices relating to the handling of Personal Information. The Beanstalk Project will investigate and respond within thirty (30) days of receipt of such inquiry or complaint. If a complaint is found to be justified, The Beanstalk Project will take appropriate measures to resolve such complaint, including, if deemed necessary by The Beanstalk Project, amending this Privacy Policy and related privacy procedures.
A User may withdraw their consent to the collection, use and disclosure of Personal Information by The Beanstalk Project at any time, subject to legal and/or contractual restrictions and upon reasonable notice, by contacting the Privacy Officer. Please note that certain Personal Information will be collected automatically when a User visits the Websites. A User’s continued use of the Websites will be deemed consent to obtain any Personal Information that derives from the User’s access and/or use of the Websites.
Terms and Conditions of Use of Websites
The Beanstalk Project’s Terms and Conditions of Use governing a User’s use of the Websites (accessible by clicking here) contains important provisions, including provisions disclaiming, limiting or excluding the liability of The Beanstalk Project for a User’s use of the Websites and provisions determining the applicable law and exclusive jurisdiction for the resolution of any disputes regarding a User’s use of the Websites. Each of those provisions applies to any disputes that may arise in relation to this Privacy Policy including any collection, use and disclosure of Personal Information and are of the same force and effect as if they had been reproduced directly in this Privacy Policy.
Third Party Links and Websites
The Websites may contain links to third-party websites or internet resources, which are not affiliated with the Websites and are not subject to this Privacy Policy. The User assumes the risk associated with the User’s use and/or access of any third-party links or websites. The Beanstalk Project assumes no responsibility or liability for, or control over any third-party websites or their collection, use and/or disclosure of a User’s Personal Information, other than as expressly set out herein.
Privacy Policy Amendments and Revisions
This Privacy Policy may be revised and/or amended at the sole discretion of The Beanstalk Project without prior notice or liability to the User or any other person. The collection, use and disclosure of the Personal Information by The Beanstalk Project will be governed by the version of the Privacy Policy in effect at that time when the information is collected, used or disclosed. New or amended versions of this Privacy Policy will be posted on the Websites and will be available to the User upon request to the Privacy Officer. A User’s continued access, use or dealings with the Websites after any amendments to this Privacy Policy will signify a User’s consent and continued consent to the collection, use and disclosure of Personal Information in accordance with the revised Privacy Policy.
Anti-Spam
The Beanstalk Project complies with the requirements of Canada’s anti-spam legislation (“CASL”) pertaining to unsolicited commercial e-mails, known as “spam” or “junk mail”. If a User subscribes for electronic communications or newsletters from The Beanstalk Project and/or the Websites, such User will have the option to immediately unsubscribe.
